コモンズの概念

今卒業論文を書いていて、ローレンス・レッシグ氏のコモンズを参考文献のひとつとして扱おうと思っている。レッシグ氏の考え方も共感できるものが多く素晴らしいが、日本語訳の山形浩生氏の文体というか文面も素晴らしい。原文がどのようなものか分からないが、卒業論文でもこのような文体でつづっていければ都合がよいように思う。表現として語弊があるかもしれないが、少々カジュアルな文体は論文には向いていないのだろう。"少々"というのは堅すぎず柔らかすぎることもないということであるが、論文のスタイルを短編の本を出版するつもりで書き連ねていくのであれば筆もすらすら進みそうだ。

さて、blogについて調べていたところ伊藤穣一氏のblogに無料の本『Free Culture』が売れている？というエントリーがあったので参考にしたい。

CCライセンスと無料ダウンロードが、『Free Culture』の売上に貢献しているかどうかを証明するのは難しい。だけど、無料ダウンロードが売上を妨げるものではないのは確かだろう。電子版の無料提供と本の売上増の関係を示すことは可能だろうか？

「Free Culture」はレッシグ氏の著書であるが、クリエイティブコモンズの理念によって無料でダウンロードできるようになっている。僕の解釈が間違っていなければ、コモンズは創造性を高めるためにフリーな社会を築いていくべきだということを提唱しており、フリーの意味は"無料"ではなく"自由"ということになる。レッシグ氏自身の周辺環境への態度ともいえるが、著書を無料配布しているとは知らなかった。レッシグ氏がこの効果を予想していたかどうかは知る由もないが、結果的に無料でダウンロードすることができるにも関わらず出版物が売れているということは興味深いところだ。

タレントなり音楽なり、露出すればするほど売れるようになるというのは、レコード会社が、ラジオでかけてもらうためにDJにレコードを渡していた時代から変わらないと思います。本の場合、無料の電子版を持っている人が、途中から紙で読みたくなって本を買うというパターンもありそうです。

伊藤氏の考えに付け加えて、WinMXやWinnyなどP2P技術による議論をしていたときのことを記述したい。P2P技術を取り締まるかどうかという議論をしていて、著作権のある音楽ファイルをダウンロード可能な状態にしておくことは違法であるが、無名のアーティストが自身の音楽を多くの人に聞いてもらいたい目的で公開することも制限してしまうのはどうかという論点があった。こういった場合、P2Pを上手く利用すればアーティスト側でハッピーになれる可能性が出てくるという話なので、上手くパラダイムシフトできればよいなと考えたことがある。
新しい技術や概念を上手く時代に載せること、それはコモンズのような態度を多くの人が振舞えれば可能だろうか。しかし現実はそうはいかない。現実は個人の利益を追求しがちであるのだから。
